It has become very apparent lately that the specifications of roof insulation materials in BOQs are constantly being changed to cheaper and in many cases inferior/imported products to save money and win roofing contracts. This is highly irregular and we would like to draw your attention to the following regulation as part of the South African National Building Regulations:
In accordance with the National Building Regulations, Part A – Administration, A25 General Enforcement sub section (5) “Any person who, having obtained approval in terms of the Act for the erection of any building, deviates to any material degree from any plan, drawing or particulars approved by the local authority shall, except where such deviation has been approved, be guilty of an offence”.
Furthermore the National Regulator for Compulsory Specifications (NRCS) which is the custodian of our National Building Regulations and is regulated by the Department of Trade & Industry (DTI) is responsible for assuring that specifications are in line with technical regulations, human health and safety, fair trade and in accordance with government policies and guidelines.
Therefore if the change of product specification is not done according to these guidelines and procedures and not approved in writing by the local authority, such change is a serious breach and could affect the professional indemnity of the party concerned. It is the responsibility of the specifying professional to follow these procedures and product specification changes may under no circumstances be done or approved by a contractor or any other party.
